These Terms of Service (“Terms”) govern your access to and use of Hercules, SuperJ, and all related services, tools, integrations, interfaces, and materials provided by Jupiter Meta Labs (“Company”, “we”, “our”, “us”).
By accessing or using Hercules, creating an account, or deploying a survey via SuperJ, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
1. INTRODUCTION
1.1 Contractual Relationship
These Terms constitute a binding agreement between the User (“you”, “Customer”, “Account Holder”) and Jupiter Meta Labs. They apply to:
- your access to and use of Hercules, an online market-research SaaS platform;
- your connection to the SuperJ verified-consumer ecosystem when deploying surveys;
- your use of all AI-driven features, including survey creation, insight generation, targeting logic, dashboards, and CSV exports;
- any data, content, media, or material you upload, submit, or generate using the Service.
1.2 Linked Ecosystem
Hercules interacts with SuperJ solely for survey deployment and response collection. SuperJ is populated by verified users located in India who have consented to participate in anonymised market research through pseudonymous identifiers (“DIDs”). Hercules does not receive or process PII of SuperJ respondents.
1.3 Acceptance of Policies
These Terms incorporate by reference:
- the Hercules Acceptable Use Policy (“AUP”);
- the Privacy Notice;
- any product-specific guidelines or instructions we publish;
- future policies or addenda we may introduce.
2. DEFINITIONS
- “Account” means an individual Hercules account created by a User.
- “Aggregated Insights” means non-identifiable analytical summaries derived from Survey Data.
- “AI Features” means Hercules’ AI-powered tools for survey generation, analysis, and insights.
- “Anonymous Identifier” or “DID” means the irreversible pseudonym assigned to SuperJ respondents.
- “Applicable Law” means all laws applicable to the Service, including the Digital Personal Data Protection Act 2023 (DPDP), the Information Technology Act 2000, rules framed thereunder, and other relevant Indian or international regulations.
- “Content” means any text, data, survey, media, document, file, prompt, or material you upload or generate on the Service.
- “Customer Content” means Content submitted by the Customer.
- “Free Plan” means the no-cost tier of Hercules where Customer Content may be used for model improvement.
- “Pro Plan (Privacy Mode)” means the paid tier where Customer Content is excluded from model training.
- “Media Uploads” means images, photographs, PDFs, videos, or other materials submitted to Hercules.
- “Minor User” means an individual between 13 and 17 years old.
- “Service” or “Hercules” means the proprietary market-research software offered by the Company.
- “SuperJ” means the Company’s verified-consumer platform for survey response collection.
- “Survey Data” means all responses collected through SuperJ in relation to a Customer-deployed survey.
- “User” or “Customer” means any individual accessing Hercules.
3. ELIGIBILITY AND AGE REQUIREMENTS
3.1 Eligibility to Use Hercules
You may use Hercules if you are 13 years of age or older. Minor Users (13–17) may create surveys subject to Section 13 (Minors Policy).
3.2 SuperJ Respondents
SuperJ respondents are 18 years of age or older. Customers cannot target minors and will not receive responses from minors.
3.3 Authority
If you are using the Service on behalf of another individual or entity, you represent that you have the authority to bind that individual or entity to these Terms. However, the Service is not an enterprise offering, and accounts are treated as individual accounts only.
4. ACCOUNT REGISTRATION AND RESPONSIBILITIES
4.1 Account Creation
To access Hercules, you must create an Account using a valid email address.
4.2 Work Email Addresses
If you register using a work or organisation email address, the Company does not assume responsibility for disputes between you and your employer. Accounts remain individual.
4.3 Accuracy of Information
You must provide accurate information during registration and maintain the accuracy of such information.
4.4 Account Security
You are responsible for:
- keeping your login credentials secure;
- preventing unauthorised access;
- all activity under your Account.
4.5 Login Sharing
Login sharing is discouraged. Repeated or abusive sharing may lead to restricted access or account suspension.
4.6 Prohibition on Circumvention
You must not circumvent or attempt to circumvent authentication, security, or usage-limitation mechanisms.
5. DESCRIPTION OF THE SERVICE
5.1 Scope
Hercules is a market-research platform that provides:
- AI-generated survey creation;
- AI-generated insights and analysis;
- tools to configure targeting parameters;
- deployment of surveys to the SuperJ respondent pool;
- dashboards and analytics for project management;
- ability to download DID-based CSVs;
- a credits-based system to prepare and deploy surveys;
- media upload capabilities for research tasks;
- future modules introduced by the Company.
5.2 AI Outputs Not Guaranteed
Hercules uses AI models that may generate outputs that are probabilistic, incomplete, or inaccurate. Insights generated by AI should not be treated as legal, financial, medical, diagnostic, or professional advice.
5.3 No PII Transfer
Hercules never receives or transfers PII of SuperJ respondents. All Survey Data is delivered with pseudonymous identifiers and demographic attributes only.
5.4 Availability
The Service may be subject to maintenance, updates, suspensions, or interruptions. We are not liable for unavailability.
5.5 No Enterprise Features
The Service does not currently include multi-seat administration, SSO, SAML, SCIM, enterprise SLAs, or organisational reporting.
6. CUSTOMER CONTENT
6.1 Ownership
You retain ownership of Customer Content submitted to Hercules.
6.2 Licence to Company
You grant the Company a limited, revocable, non-exclusive licence to process Customer Content for the purposes of:
- providing the Service;
- generating AI-driven outputs;
- safety, moderation, and abuse prevention;
- training and product-improvement (Free Plan only).
6.3 Prohibited Content
You may not upload Content that:
- is illegal, harmful, abusive, or deceptive;
- violates any intellectual property rights;
- contains explicit or sexually graphic content;
- contains depictions of minors in sensitive, unsafe, or adult situations;
- is hateful, harassing, or discriminatory;
- violates Applicable Law;
- constitutes harmful instructions or operational guidance beyond market-research purposes.
6.4 Responsibility
You are solely responsible for the accuracy, legality, and appropriateness of Customer Content.
7. MEDIA UPLOADS
7.1 Permissible Uploads
You may upload images, photographs, documents, screenshots, PDFs, and videos solely for market-research purposes.
7.2 Scanning and Moderation
Media Uploads may undergo automated or human review to ensure compliance with:
- these Terms;
- the AUP;
- Applicable Law.
7.3 Prohibited Media
You must not upload media that:
- includes nudity, pornography, sexual content, or sexualised depictions;
- contains minors in unsafe or adult contexts;
- depicts violence, abuse, or self-harm;
- is hateful or discriminatory;
- infringes third-party rights;
- is unlawful, fraudulent, or misleading;
- attempts to identify SuperJ respondents.
7.4 Deletion
Media removed by you is permanently deleted, except where necessary for safety investigations, abuse reporting, or compliance with legal obligations.
8. SURVEY DEPLOYMENT AND VERIFIED CONSUMER ACCESS
8.1 Deployment via SuperJ
Surveys created in Hercules may be deployed to verified SuperJ respondents. Respondents receive surveys through the SuperJ application.
8.2 DID-Based Responses
Customers receive Survey Data in the form of:
- DID;
- age bracket;
- gender;
- regional attributes;
- question-level responses.
8.3 Prohibition on Re-Identification
You must not attempt to reverse engineer, de-pseudonymise, cross-reference, or re-identify any respondent.
8.4 Sampling Logic
The Company maintains full control over sampling, eligibility, and response routing based on safety, fairness, and demographic balancing.
8.5 No Guarantee of Responses
The Company does not guarantee a specific volume of responses, demographic distribution, or completion speed.
9. DATA ROLES (CONTROLLER/PROCESSOR)
9.1 Customer as Controller
For Customer Content and survey configuration, you act as the Data Controller.
9.2 Company as Processor
For Customer Content and Survey Data collected in response to your surveys, the Company acts as a Data Processor.
9.3 Company as Independent Controller
For:
- operation of SuperJ;
- DID generation and pseudonymisation;
- respondent recruitment, verification, and management;
- platform-wide analytics and safety mechanisms;
the Company acts as an Independent Data Controller.
9.4 No PII Transfer
SuperJ respondents' contact details or PII are never transferred to Customers.
10. DATA USAGE: FREE PLAN VS PRO PLAN (PRIVACY MODE)
10.1 Free Plan – Data Usage and Model Training
If you are on the Free Plan, you acknowledge and agree that:
- Customer Content, including surveys, text prompts, and Media Uploads, may be used for: (i) model training; (ii) algorithm refinement; (iii) safety and abuse detection; (iv) performance improvement; (v) testing and benchmarking; (vi) aggregated analytics.
- Data used for model improvement is processed in accordance with Applicable Law and is never linked to personal identifiers.
- You cannot opt out of training under the Free Plan. To opt out, you must upgrade to the Pro Plan (Privacy Mode).
10.2 Pro Plan (Privacy Mode) – No Training
If you are on the Pro Plan:
- Customer Content is excluded from all training datasets, including: (i) model fine-tuning; (ii) optimisation; (iii) benchmarking; (iv) synthetic dataset creation.
- Only non-content, aggregated system metrics may be used (e.g., number of surveys created, tool usage statistics).
10.3 Historical Data
Upgrading from Free to Pro does not affect historical Free Plan content already used for model training. No “untraining” occurs.
10.4 Survey Data Exclusion
Regardless of plan:
- Survey Data (respondent answers, demographics, DIDs) is never used to train AI models;
- respondent data remains pseudonymised and is excluded from model improvement.
11. CREDITS, BILLING AND REFUNDS
11.1 Credits System
Hercules uses a credits-based system for survey deployment:
- credits are consumed when a survey is prepared for deployment (“Ready to Go Live”);
- credits are not consumed at the drafting stage.
11.2 Refunds Before Deployment
If a Customer cancels a survey before activation, all consumed credits for that survey are refunded to the Customer’s wallet.
11.3 Refunds After Deployment
Credits are non-refundable once a survey is activated or deployed.
11.4 Subscription Payments
Subscriptions, including the Pro Plan, are billed on a recurring basis and are non-refundable.
11.5 No Cash Refunds
Refunds are issued as credits and will not be converted into cash.
11.6 Credit Expiry

11.7 Free Trials
Free Trials may include limited features subject to restrictions determined by the Company. Free Trial content is processed in accordance with the Free Plan training rules.
12. ACCEPTABLE USE AND PROHIBITED CONDUCT
12.1 General Obligations
You must use the Service responsibly and in compliance with these Terms, the AUP, and Applicable Law.
12.2 Prohibited Uses
You must not use the Service to:
- create, upload, transmit, or distribute content that is illegal, harmful, abusive, defamatory, harassing, obscene, pornographic, or otherwise objectionable;
- engage in fraud, deception, misinformation, impersonation, or exploitation;
- provide harmful advice or actionable instructions outside market-research scope;
- conduct or promote unlawful surveillance, stalking, or tracking of individuals;
- attempt to access or collect PII of SuperJ respondents;
- upload malware, viruses, or harmful code;
- reverse engineer, decompile, or attempt to extract model parameters, architecture, training methodologies, or datasets;
- interfere with or disrupt the Service’s operations, servers, or networks;
- access the Service in violation of export-control restrictions.
12.3 Survey Content Restrictions (For All Users)
Customers must not create surveys involving:
- pornography, nudity, sexual content, or sexualisation of individuals;
- illegal activities;
- extremist, hateful, or violent content;
- medical diagnosis or clinical assessments;
- financial risk advice, investment suitability, or creditworthiness;
- political persuasion, political targeting, or election influence;
- criminal profiling, law enforcement impersonation, or identity solicitation;
- minors in unsafe, exploitative, or adult contexts.
12.4 Misrepresentation
You may not misrepresent the purpose of your survey or attempt to collect sensitive personal information in violation of DPDP or these Terms.
12.5 Automated Access
Automated access, scraping, or crawling of the Service is prohibited unless explicitly authorised.
12.6 Fair Use
The Company may impose usage limits to maintain Service quality and prevent abuse.
13. MINORS POLICY (13–17)
13.1 Eligibility
Individuals aged 13 to 17 may create an Account and use Hercules to design surveys.
13.2 Prohibited Survey Topics for Minors
Minor Users may not create surveys involving:
- sexual content, adult content, dating or sexual wellness;
- alcohol, tobacco, vaping, drugs, or controlled substances;
- gambling, betting, or real-money games;
- political ideology, political advertising, political persuasion, or elections;
- investment, trading, cryptocurrency, or financial risk instruments;
- medical symptoms, diagnoses, or mental health assessments;
- violent, extremist, or hateful content;
- illegal or unsafe activities.
13.3 Survey Deployment by Minors
All surveys created by Minors may only be deployed to adult SuperJ respondents.
13.4 Moderation for Minor Accounts
Minor accounts are subject to enhanced monitoring and automatic topic-blocking.
13.5 Misuse by Minors
If a Minor User repeatedly attempts to create prohibited content, the Company may:
- block specific features;
- restrict deployment;
- suspend or terminate the account.
14. SAFETY, MODERATION AND ENFORCEMENT
14.1 Safety Responsibilities
We maintain safeguards designed to ensure that:
- survey content is appropriate and lawful;
- media uploads do not contain harmful or illegal content;
- AI-generated material does not violate these Terms;
- SuperJ respondents receive safe, non-harmful survey experiences.
14.2 Automated Moderation
Some Content may be automatically scanned for:
- illegal or prohibited topics;
- content involving minors in unsafe contexts;
- explicit material;
- violence or hate speech;
- attempts to gather PII;
- policy violations under the AUP.
14.3 Human Review
Where necessary, Content may be reviewed by authorised personnel to assess:
- safety violations;
- legal risk;
- breaches of Terms;
- harmful activity or misuse.
14.4 Actions We May Take
The Company may:
- refuse to deploy a survey;
- disable Media Uploads;
- restrict access to AI Features;
- lock, suspend, or terminate Accounts;
- delete Customer Content;
- notify legal authorities where required.
14.5 Appeals
Users may contact the Company to appeal moderation decisions; however, appeals do not guarantee reinstatement.
15. CONFIDENTIALITY
15.1 Customer Confidential Information
We will not disclose Customer Confidential Information to third parties except:
- where necessary to operate the Service;
- to comply with legal obligations;
- to enforce these Terms;
- with your explicit consent.
15.2 Company Confidential Information
You must not disclose:
- proprietary algorithms;
- model behaviour information;
- model training techniques;
- performance benchmarks;
- platform architecture;
- non-public documentation or communications.
15.3 Exclusions
Confidentiality obligations do not apply to information that:
- becomes publicly available through no breach of these Terms;
- is independently developed;
- was rightfully received from a third party;
- must be disclosed pursuant to law.
16. INTELLECTUAL PROPERTY
16.1 Ownership
All rights, title, and interest in:
- Hercules;
- SuperJ systems;
- AI models;
- algorithms;
- visual interfaces;
- design elements;
- data processing pipelines;
are owned exclusively by the Company.
16.2 Restrictions
You shall not:
- copy, reproduce, or modify the Service;
- decompile, reverse engineer, or discover source code;
- extract or reuse datasets;
- circumvent technological protections;
- build competing products using the Service;
- violate intellectual property rights.
16.3 Customer Content
Ownership of Customer Content remains with you, subject to the licences granted under Section 6.
16.4 Feedback
If you provide feedback, suggestions, or improvement ideas, you grant the Company an irrevocable, royalty-free, worldwide licence to use such feedback for any purpose.
17. DISCLAIMERS AND WARRANTIES
17.1 Service Provided “As Is”
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Company disclaims all warranties, whether express, implied, statutory, or otherwise, including:
- merchantability;
- fitness for a particular purpose;
- non-infringement;
- accuracy, reliability, or completeness of AI outputs;
- uninterrupted or error-free availability.
17.2 AI Limitations
You acknowledge that:
- AI-generated survey suggestions or insights may contain inaccuracies;
- outputs may be incomplete, biased, or inappropriate;
- outputs are not legal, financial, medical, diagnostic, or investment advice;
- the Company disclaims liability for decisions made based on AI outputs.
17.3 Survey Data Limitations
The Company does not warrant that:
- Survey Data will achieve specific response volumes or demographic quotas;
- SuperJ respondents will complete surveys within a particular timeframe;
- insights derived from Survey Data will meet your expectations or commercial objectives.
17.4 No Guarantee of Harm-Free Use
While the Company implements safety and moderation measures, we do not warrant that:
- harmful content will never appear;
- automated systems will detect all violations;
- human review will resolve all issues.
17.5 Third-Party Services
The Service may interact with third-party services. The Company disclaims responsibility for such services.
18. LIMITATION OF LIABILITY
18.1 Exclusion of Indirect Damages
To the maximum extent permitted by law, the Company will not be liable for:
- indirect, incidental, special, punitive, or consequential damages;
- lost profits, business interruption, or loss of data;
- reputational harm, commercial loss, or opportunity loss;
- any damages arising from your reliance on AI outputs.
18.2 Cap on Direct Damages
The Company’s total liability for all claims arising from or related to the Service will not exceed: (a) the amounts paid by you to the Company in the preceding 12 months, or (b) INR 10,000 — whichever is lower.
18.3 Exceptions
The above limitations do not apply to liability that cannot be excluded under Applicable Law, including:
- wilful misconduct;
- gross negligence resulting in personal injury;
- non-excludable statutory obligations.
18.4 Customer’s Responsibility
You are responsible for:
- all Customer Content you upload;
- verifying the suitability of AI outputs;
- ensuring your survey complies with Applicable Law;
- any consequences arising from your survey design or deployment.
19. TERMINATION
19.1 Termination by Customer
You may terminate your Account at any time by using the in-platform deletion tools.
19.2 Termination by Company
We may suspend or terminate your Account, with or without notice, if:
- you violate these Terms or the AUP;
- you repeatedly attempt to upload prohibited content;
- you misuse the platform for unlawful or harmful purposes;
- we detect fraudulent activity;
- required by law or regulatory authorities.
19.3 Effect of Termination
Upon termination:
- your Account is deactivated;
- Customer Content is permanently deleted, except where retention is legally required;
- credits in your wallet are forfeited;
- Survey Data already collected may continue to be used for Aggregated Insights consistent with Section 9, unless deletion is required due to harmful misuse.
19.4 Termination Due to Harmful or Explicit Content
If termination results from:
- explicit content;
- harmful instructions;
- illegal activity;
- attempts to gather PII;
- attempts to re-identify respondents,
the Company will:
- permanently delete all associated Customer Content;
- purge such content from training sets (if Free Plan);
- permanently remove related Aggregated Insights.
19.5 Survival
The following Sections survive termination: Sections 6, 10, 12, 14, 15, 16, 17, 18, 20, and 21.
20. GOVERNING LAW, DISPUTE RESOLUTION AND EXPORT CONTROLS
20.1 Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
20.2 Jurisdiction
Disputes shall be subject to the exclusive jurisdiction of the courts of: Hyderabad, Telangana, India.
20.3 Informal Resolution
Before raising legal proceedings, you agree to attempt good-faith informal resolution by contacting us.
20.4 Export Controls and Sanctions
The Service is operated primarily in India, but Customers accessing Hercules from outside India must comply with:
- Indian export-control laws administered by the Directorate General of Foreign Trade (DGFT);
- restrictions under the Consolidated Sanctions List of the Ministry of External Affairs;
- United Nations Security Council sanctions;
- United States OFAC sanctions;
- any other relevant trade restrictions.
You agree not to:
- use Hercules in restricted countries;
- access or deploy Hercules on behalf of a sanctioned entity;
- engage respondents located in jurisdictions subject to international sanctions.
20.5 Anti-Corruption
You warrant that you will comply with applicable anti-corruption laws including the Prevention of Corruption Act 1988.
20.6 No Legal Advice
Nothing in the Service constitutes legal advice. You must obtain professional advice for compliance or regulatory decisions.
21. MISCELLANEOUS PROVISIONS
21.1 Entire Agreement
These Terms, including the AUP and linked policies, constitute the entire agreement between you and the Company.
21.2 Amendments
We may modify these Terms at any time. Your continued use constitutes acceptance of updated Terms.
21.3 No Waiver
Failure to enforce any provision is not a waiver of that provision.
21.4 Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
21.5 Assignment
You may not assign or transfer your rights under these Terms. The Company may assign these Terms to affiliates or successors.
21.6 Notices
Notices will be delivered via:
- email to your registered address; or
- in-product notifications.
21.7 Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, outages, war, civil disturbance, labour disputes, or cyber-attacks.
21.8 Relationship of Parties
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
21.9 Language
These Terms are drafted in English, which governs in case of translations.
